1) Scope
These General Terms and Conditions (hereinafter “GTC”) apply to all contracts for the delivery of goods concluded between an online shop operator (hereinafter “Seller”) and consumers or entrepreneurs (hereinafter “Customer”).
Conflicting or deviating terms of the Customer shall not apply unless the Seller expressly agrees to their validity.
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (Section 13 BGB). An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or independent professional activity (Section 14 BGB).
2) Conclusion of the contract
The product descriptions presented in the online shop do not constitute binding offers but serve as an invitation for the Customer to submit a binding offer.
The Customer submits a binding contractual offer by placing the selected goods in the virtual shopping cart, going through the electronic ordering process and completing the order by clicking the button provided for this purpose.
The Seller may accept the Customer's offer within five days by sending an order confirmation in text form (e.g. e-mail), by delivering the goods or by requesting payment. The contract is concluded upon the occurrence of whichever of these alternatives occurs first.
If a payment service provider is selected, payment is processed via the respective provider subject to its terms of use. Upon completion of the payment process, the Seller declares acceptance of the offer.
The contract text is stored after conclusion of the contract and sent to the Customer in text form. If a customer account exists, order data can be viewed there.
Input errors can be identified and corrected before the order is submitted bindingly. The language of the contract is exclusively German.
Communication usually takes place by e-mail. The Customer must ensure that the e-mail address provided is reachable.
3) Right of withdrawal
Consumers have a statutory right of withdrawal of 14 days in accordance with Section 355 BGB.
Details of the right of withdrawal, how to exercise it and the consequences of withdrawal are set out in the Seller's separate cancellation policy.
4) Prices and terms of payment
All prices are total prices including statutory VAT. Additional delivery and shipping costs are shown separately.
The available payment methods are displayed to the Customer in the online shop.
If payment in advance has been agreed, the purchase price is due immediately after conclusion of the contract.
5) Delivery and shipping terms
Delivery is made to the delivery address specified by the Customer.
For goods shipped by freight forwarder, delivery is made free to the kerbside unless otherwise agreed.
If delivery fails for reasons for which the Customer is responsible, the Customer shall bear the resulting additional costs.
If the goods are unavailable because the Seller was not supplied by its own supplier, the Seller may withdraw from the contract. Payments already made will be refunded without delay.
Collection by the Customer is excluded.
If a confirmed delivery is refused without a prior declaration of withdrawal, the Customer shall bear the resulting shipping and return costs. A refund is made less the delivery costs incurred.
6) Retention of title
The delivered goods remain the property of the Seller until the purchase price has been paid in full.
7) Liability for defects (warranty)
The statutory warranty rights under Sections 434 et seq. BGB apply.
Consumers are asked to report obvious transport damage to the delivery agent. Failure to do so has no effect on statutory claims.
Unauthorised repairs or modifications may lead to the loss of warranty or guarantee claims if they make it more difficult to establish the original defect or cause further damage.
8) Alternative dispute resolution
The EU Commission provides a platform for online dispute resolution (ODR):
https://ec.europa.eu/consumers/odr
The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
